Called to Order at 7:55 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5. by Ron Grattan, Vice Chairman in Meeting Room A at the Town Hall.

Public Hearings

7:45 PM Request for Determination of Applicability for the repair of a septic system at 304 King Street, Assessor’s Map 115, Lot 2-2 for Stephen & Marcia Savoy represented by James Engineering, 125 Great Rock Road, Hanover, MA  (New Hearing) – continued per request of applicant until September 27, 2005 at 8:15 PM

8:00 PM  Request for Determination of Applicability for construction of a 16,875 s.f. addition  that includes grading and the construction of a concrete retaining wall, an emergency gravel access drive, infiltration trench and a roof runoff infiltration system at 243 Franklin Street, Assessor’s Map 52, Lots 1A & 1B for President Titanium represented by Land Planning, Inc., 1115 Main St., Hanson, MA  (New Hearing)

Sean Chrisman read the Public Hearing Notice and the abutters list was verified.  Steve Wry of Land Planning made the presentation for a proposal of an addition.  The extra space will be utilized as office and a warehouse.  Parking spaces are to be relocated to a different area, with no increase in stormwater runoff.  A small portion of a gravel drive is within 100-feet of the resource area.  Ms. Delaney had inspected and determined that there had been clearing right up to the wetland and that some wetland flags were missing.  However, the wetland is not in our jurisdiction as it is across the town line into East Bridgewater.  She suggested that if the Commission makes a decision that John W. Delano’s comment letter be referenced therein with a copy of said decision to the East Bridgewater Conservation Commission.

8:15 PM  Notice of Intent for a proposal for a four (4) lot residential subdivision with 640 linear feet of roadway.  Total area = 18.98 acres at 1460 Main Street, Assessor’s Map 44, Lots 5F & 7C for Jack Van Aiken, Great Cedar Condominiums, LLC, 31 Schooset Street represented by Land Planning, Inc., 1115 Main St., Hanson, MA.  (DEP #SE175-___) (New Hearing)

Sean Chrisman read the Public Hearing Notice.  However the abutters list was flawed in that two abutters appeared not to be notified.  Also, a DEP number had not been issued.

8:45 PM  Continued Notice of Intent  for an eleven (11) lot residential subdivision with 1763 linear feet of roadway, total area = 14.31 acres at 691 East Washington St., Map 114, Lots 12 & 15 for Edward G. Johnson, P.O. Box 359, Hanson, Hanson, MA represented by Land Planning, Inc., 1115 Main St., Hanson, MA  (DEP #SE175-0477)

Steve Wry of Land Planning and Ed Johnson attended to discuss the revised Operation and Maintenance plan, specifically post-construction.  Ms. Delaney had been informed that Dick Harris, Highway Supervisor preferred a Homeowners Association rather than certain individual homeowners as responsible for perpetual maintenance of the detention basins.  A discussion ensued over the effectiveness of a Homeowners Association.  Also, Mr. Harris does not want Parcel A conveyed to the Town as it would be taking on the maintenance of the drainage structure situated on said parcel.  Ms. Delaney suggested that the hearing is closed provided that the Highway Department can come to an agreement over the Operation and Maintenance Plan.

Ms. Delaney brought up a problem with a haybale inspection at 1 Emory Street (DEP #175-422).  Alan Dias, the installer of the septic system attended to discuss some changes he would like to make in the plan, such as moving the haybale line to accommodate an ac pad, cutting of briars, installing a different size tank and permission to park equipment onsite.   Ms. Delaney suggested that Mr. Dias put his requests in writing, now and in the future so that the Board is better prepared to discuss changes.

9:00 PM  Continued Notice of Intent  for the construction of a garage at 76 Woodbrook Lane, Map 116, Lot 5-6A, Hanson, MA for Shaun MacPherson, owner   (DEP #SE175-___)  - continued per request of applicant until September 27, 2005 at 8:00 PM


9:15 PM  Request for Determination of Applicability for the installation of an 18’ x 36’ in-ground swimming pool at 108 Brook Street, Assessor Map 97, Lot 8B-1 for owner Michael Boussy  (New Hearing)

Sean Chrisman read the Public Hearing Notice and the abutters list was verified.  Mr. & Boussy made the presentation.  Their entire property is in the 100-foot buffer zone.  Their proposal for the pool is within 20 feet of a wetland delineated by Patricia Cassady.   Ms. Delaney commented that the wetland line is not established on the plan, the perennial stream is not shown and the existing structures such as a shed and a dog pen are not shown as well.  In addition, the proposal does not meet the requirements for an exemption from the Riverfront Act.

9:30  Request for Determination of Applicability for a septic system repair within 100 feet of a Bordering Vegetated Wetland at 50 Holmes Street, Assessors Map 66, Lot 1 for owners Robert & Susan Leahy  (New Hearing)

Sean Chrisman read the Public Hearing Notice and the abutters list was verified.  Bob Crowell of Land Planning made the presentation for the septic system that was out of the 50-foot buffer zone.  Ms. Delaney thought that the haybales were excessive.

Discussion with Steve Nicoletta, 61 Ocean Ave. regarding the removal of tree on his property (DEP #175-0453)

Mr. Nicoletta attended the meeting and requested permission in writing to cut a tree on his property because it was in danger of falling into the pond.  Pictures were provided.  He was advised that he could cut the tree, but not stump it, to cut it flush and to replace said tree somewhere else on the property with a 5-inch caliper maple tree.

314 Maquan St. /Building permit application – Ms. Delaney advised of activity within 65-feet of the pond with heavy equipment.  A Commission member will inspect.
 
Dunham Farms update – Ms. Delaney reported that everything was according to plan of record.
Ridder property – Ms. Delaney will research history of property.
Acorn Road, map 93, Lot 7 – Ms. Delaney had received anonymous complaint of cutting in wetland.   Ms. Delaney had done a drive-by and had not observed any wetlands.

Construction General Permit (EPA) – Ms. Delaney suggested Town of Hanson adopt a blanket permit for minor projects such as septic systems, sheds, decks and above-ground pools that are proposed out of the 50-foot no disturb zone.   She will have something drafted for the next meeting for the Commission’s review.
